Risk of Software Availability

Although we make reasonable efforts to ensure that the Platform follows high-security standards, we do not warrant or represent that the Platform is secure or safe, or protected from phishing, malware, hacking, or other malicious attacks. Further, the Platform may contain weaknesses, bugs, vulnerabilities, viruses, or other defects which may have a material adverse effect on the operation of the Platform or may lead to losses and damages for you, other users of the Platform, or third-parties.

Risks Inherent to Blockchain Technology

Given that on-chain transactions operate as an autonomous public peer-to-peer network on the blockchain, beyond our control, we hereby disclaim any responsibility for failures, errors, breaches, or inaccuracies occurring on the blockchain or any associated networks. Users shall be subject to any modifications or amendments, such as forks, made to the blockchain system protocol. We provide no representations or warranties, whether express or implied, statutory or otherwise, regarding the functionality of the blockchain nor do we assume liability for any breaches of security associated with blockchain technology.

Risk Inherent in the Smart Contracts

The Platform partially relies on and interacts with smart contracts that can be used to carry out certain automated transactions involving digital assets, token distribution, and execution of ICO investment terms. Smart Contracts can also be subject to vulnerabilities, particularly because they are stored on-chain, including but not limited to, coding errors, re-entrancy attacks, integer overflows, malfunctions, and exploits, which could result in financial losses. We do not provide any warranties or representations regarding the smart contracts deployed, since there are factors occurring outside of our control that may materially impact the underlying technology. The smart contracts may not (i) perform as intended, (ii) meet your expectations, (iii) be secure or error-free, (v) fit for a particular purpose. Our smart contracts have been audited by an independent external third-party partner however, this does not guarantee the security of the smart contract which may still be impacted by external factors.

Project Risk

ICOs represent risky participation in early-stage projects, with unproven business models, technologies, and teams. There is a material risk of project failure, mismanagement, or inability to deliver on promised milestones. Participants should conduct thorough due diligence and assess the credibility and viability of Selected Projects before investing.

Project Documentation may contain information which is incomplete, inaccurate, or misleading. You should exercise caution and conduct independent research to verify the accuracy and reliability of Project Documentation.

Past performance of a particular Selected Project, or of a particular Selected Project Team, is not indicative of future results, and you should be prepared to accept the possibility of losing your entire funds.

Economic Risk

Participation in early-stage projects are speculative in nature and may not generate expected returns or profits. You should look at participating in projects you have a genuine interest in, with a utility you are likely to utilize. Economic downturns, market downturns, or adverse events may adversely affect the value of a Project Token and could lead to substantial losses.

Token Risk

Rampstarter makes no guarantee of the success or viability of the Selected Project Tokens and makes no guarantee that the Selected Project Tokens will be successfully listed on public exchanges, or that even if they are listed, that they won’t subsequently be delisted. Policies surrounding listing and delisting of tokens are dependent on a range of factors which are outside the control of Rampstarter.

Staking Risk

Staking involves a lockup period during which you acknowledge and accept that you will not have immediate access to your staked virtual assets. We do not provide any guarantee regarding the success or viability of any staking activities. Staking can result in an increase and decrease in the value of your virtual asset. Staked assets can also face protocol and slashing risks leading to a loss of staked assets and rewards.

Non-Solicitation and Recommendation

We do not provide any form of advice in relation to our Services. You acknowledge and agree that any decision to utilize our Services on the Platform is solely made by you. No communication or information provided by us should be construed as investment advice, financial advice, trading advice, or any other type of advice. Our Services are not intended to provide financial advice and any content provided should not be construed as a recommendation. Users should consult with qualified professionals before making any financial decisions. Any tokens, prices, and Services offered through the Platform, or via a Third Party Partner, should not be considered as a recommendation or solicitation by Rampstater, to buy or engage in any transaction involving any virtual assets.

Risk of Inaccurate Data

The Platform derives certain information from the blockchain network(s) and related software in an automated manner, which means that such information is not verified or checked. As a result, such information can be incorrect, incomplete, untimely, inaccurate, or insufficient. No warranties are being made that any information provided in connection with the Platform or on the Platform, will be complete or accurate.

Risk of Inaccurate Information and Projections

Due to the nature of the market, trends, and an evolving regulatory landscape, we cannot guarantee that the information provided will always be up to date, and it is your responsibility to ensure you are kept up to date of changing trends and of the ever-changing regulatory landscape.

These are risks associated with such reliance on Third Party Partners, which are out of Rampstarter’s control and/or influence, including the possibility of untimely or unreliable actions, delays, deviation from expected or intended conduct, or outright failure to act. These circumstances may result in the unavailability of Platform functionalities and/or smart contracts, inaccurate Token Allocation, or the partial or complete loss of associated Digital Assets.

Value and Volatility

The prices of Digital Assets are highly volatile and subjective, and such assets may lack inherent or intrinsic value. Fluctuations in the price of other digital assets could have a material and adverse impact on (i) the value of the Digital Assets, which may also be subject to significant price volatility, or (ii) the underlying logic of the smart contracts. We provide no assurance that any Digital Assets will maintain their original value, achieve any specific price, or possess any particular value. Additionally, we make no representations regarding the profitability of utilizing the Platform, as the value of Digital Assets is contingent upon external factors beyond our control, which may significantly impact the value and desirability of any particular Digital Assets. The volatility and unpredictability of the value of Digital Assets in comparison to fiat currency, defined as a government-issued currency designated as legal tender, may result in substantial or complete losses within a short period.

Liquidity Risks

This risk refers to the potential inability to sell (buy) a financial instrument at a required price due to a substantial decrease in demand for said instrument. Notably, liquidity risk may manifest when there is a need to sell a considerable quantity of financial instruments, leading to a sharp decline in their prices. You should be aware that financial instruments categorized as illiquid are prone to experiencing pronounced price fluctuations when significant transactions involving these instruments occur.

Cyber Attacks

Cybercrime is a significant concern within the digital ecosystem due to its absence of traditional governance. Virtual Assets, being entirely digital in nature, are particularly susceptible to such threats. For instance, the decentralized nature of blockchain technology may increase the risk of cyberattacks. An example of this is a 51% attack, wherein any individual or group controlling more than 50% of the network's mining hash rate can compromise the integrity of the blockchain. Attackers with majority control can disrupt the recording of new blocks, manipulate payment history, and divert funds. Users are vulnerable to various forms of cyberattacks, including malware, fake or hijacked addresses, and other malicious activities associated with holding Virtual Assets. It is essential for users to exercise caution by safeguarding passwords, verifying addresses and URLs, and exercising diligence before downloading any software.

Tax Risk

The taxation of virtual assets transactions is uncertain, and you shall be responsible for complying with the tax laws and regulations. In certain jurisdictions profits in virtual assets trading are taxable as capital gains, therefore, you are responsible in regard to tax pronouncements and you are encouraged to seek any independent legal advice and/or professional and personal tax advice. In certain circumstances, Rampstarter shall withhold taxes applicable to your transaction or payments made or deemed made to you to the extent such withholding is required by applicable law.
